TERMS AND CONDITIONS

1. Fees and Payment: I agree to pay the whole Fee to Kickstars Football prior to the child commencing the Football Course following my child’s taster session. The Fee is non-refundable under any circumstances whatsoever except with the prior written agreement from Kickstars Football. If classes are cancelled as a result of an “Act of God” (e.g. disruption resulting from extreme weather conditions i.e snow), strikes, terrorist activity, or where local authorities/public guidance advise that classes should be temporarily suspended for health or other reasons, then no refunds will be given. Unfortunately, in the event that a class is cancelled for reasons beyond our control such as bad weather, we are unable to offer make-up classes or refunds. When paying, we will accept: Monthly subscription payments or Cash at the session (receipts available on request). LATE PAYMENT FEE: Any subscriptions remaining unpaid after the second attempt following the due date shall incur a late payment fee equal to 2% of the outstanding amount, applied per day until the balance is paid in full. Late payment fees will be charged on a monthly basis.

2. Cancellation: It is a requirement that a months notice to cancel your child's subscription is given in writing by email to hello@kickstarsfootball.co.uk. Kickstars Football may cancel your child's subscription at any time before the child commences the course for any reason whatsoever. Kickstars Football shall not be liable for any loss or damage whatsoever arising from such cancellation. In the event of cancellation by Kickstars Football prior to the commencement of the Course by the child, Kickstars Football will refund any fees for outstanding classes within 30 days. I understand that sessions are to be used consecutively and that no refunds or credited sessions are provided for sessions missed during a block.

3. Parent/carer's Responsibility: The Parent/carer warrants and represents that: The information set out in the enrolment form is accurate in all respects and I will notify Kickstars Football of any change in such information immediately. When attending the Course, neither myself or my child will be suffering from any contagious illness, disease, injury or anything similar. I fully understand and accept that this activity involves risks of bodily injury, which may be caused by a child’s actions, or inactions, those of others participating in the event, the condition in which the event takes place. I acknowledge and agree that the child shall be deemed to be under the direction, care and control of myself throughout the course and I shall be responsible for the welfare and conduct of my child throughout the course and whilst my child is on the Premises. I shall indemnify and keep indemnified Kickstars Football against all loss (including loss of profit), liability, costs and expenses which Kickstars Football shall incur directly or indirectly as a consequence of any action or inaction of a Parent/carer. Kickstars Football do not accept any responsibility for personal injury, loss or damages except to the extent that it results from our negligence.

4. Discipline: In the event that Kickstars Football determines the behaviour of the child and/or the carer to be unacceptable, Kickstars Football shall be entitled to exclude the child and the carer (or either of them) from the course and/or the premises permanently or for such period as Kickstars Football shall determine. Kickstars Football operates a strict zero tolerance policy on the usage of any aggressive behaviour towards coaches and other parents/carers, along with the use of foul language during the session. We have the right to cancel the membership of a child who’s parent/carer does not comply with the Kickstars session rules.

5. Exclusion of Liability: Except in the case of fraud Kickstars Football, its coaches and employees accept no responsibility under any circumstances for any loss damage, expense or delay suffered or incurred by the parent/carer, the child or any other party arising directly or indirectly or in any way connected with the attendance of the child at the course (or any part of it) or any other act or omission on the part of Kickstars Football or any of its coaches or employees even if such act or omission is negligent. I agree (for and on behalf of the Parent/carer and the Child) that any claim by myself or my child against Kickstars Football or any coach or employee of Kickstars Football must be brought within 60 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred. I acknowledge, warrant and undertake that the maximum aggregate liability of Kickstars Football to myself or my child under these terms shall not exceed the Fee. All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of Kickstars Football, its coaches, employees or affects the statutory rights of the Parent/carer.

6. Intellectual Property and Business Protection

All lesson plans, coaching methods, class structures, activities, games, materials, and ideas used during our football activity classes are the exclusive intellectual property of Kickstars Football. Parents, guardians, or attendees are strictly prohibited from copying, reproducing, or using these ideas, in whole or in part, to create, operate, or contribute to any business or service that competes with Kickstars Football. Any such unauthorised use will be considered a breach of these Terms and Conditions and may result in legal action.

7. General: I acknowledge and read and understood the Kickstars Football Privacy Policy, which is found on the company website. These terms constitute the entire agreement and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party or which is not contained here in shall be binding or form part of this agreement.

SESSION RULES

To help us make sure that every session is as enjoyable and as safe as possible please take a few moments to familiarise yourself with our session rules set out below.

o Please remember that you are the responsible adult for your child when he/she is attending a Kickstars Football session. Responsible adults should stay in the room or within easy sight and reach of their child at all times. 

o Please help us start and finish sessions on time by arriving and registering promptly for your session. Please remember to sign-out on the register if you have to leave the session early for any reason, for emergency evacuation purposes.

o Please keep siblings, buggies and associated equipment off or as far back from the playing area at all times. ‘Pitch invaders’ are not covered by our accident insurance if they cause or are involved in an accident. 

o Please assist us to ensure that the session runs smoothly by firmly requiring your child to sit with you on the side-lines for a full 3 minute ‘time-out and calm down’ as may be requested by the coach or assistant coach at any time during the session. 

o Parents/Carers should provide drinks but no food must be eaten on the pitch or mat to avoid the hazard of choking.

o Please self-assess yourself & your child before attending every session. If you or your child are unwell and you wouldn’t send your child to school/nursery please DO NOT attend the session. 

o To comply with safeguarding guidelines and best practice we ask that you are conscious of your usage of mobile phones/cameras during the session. Although we do appreciate that you may wish to take photographs and videos of your child during the session we do ask that you ensure that no other children are included. There may be certain occasions or classes where our coaches will enforce a total ban on the use of photographic/film or video equipment by parents/carers for child protection. This will be clearly presented at your session. Due to the nature of the coaches work and the concentration required during the delivery of sessions, we are unable to guarantee this total ban, and your cooperation would be appreciated. From time to time Kickstars Football may organise class photo shoots, but only where all parental consents have been obtained." This includes trophy and tournament pictures in our older classes.

o Please try to keep noise and disturbance from the side-lines and the mat to a minimum to avoid distracting your child and others.

o Although general advice will be offered, no requests for transfers, moving up age groups or changing venues or sessions can be confirmed on the spot. Please call Kickstars Football on 07739 469069 / 07736 074596 to discuss the move or email hello@kickstarsfootball.co.uk.
